A special type of visa intended for foreign citizens who intend to carry out business or investment activities in the host country. It is issued to business immigrants who plan to open, acquire or invest in a local business.

In order for a foreign citizen to start business in Kazakhstan, he needs to obtain a C5 visa. Such activities include both the registration of a legal entity and the acquisition of shares in an existing company.

Without a C5 visa, a foreigner is not allowed to establish or become a member of an LLP. This is established by subparagraph 2 of paragraph 2 of Article 40 of the Law of the Republic of Kazakhstan "On Population Migration", according to which foreign citizens who have not issued a visa as a business immigrant do not have the right to be co-founders of commercial organizations.

This visa is only issued to adults.

1. Medical certificates on the state of health (without diseases that prevent entry).
2. Medical insurance.
3. Certificate of absence of criminal record from the country of residence.
4. Certificate of absence of injunctions against entrepreneurial activity.
Terms: visa support — 5-7 working days (in exceptional cases — up to 30 days due to coordination with the National Security Committee). The visa is pasted through the consulate.

Where it is issued: in the country of citizenship or residence of the applicant; sometimes – upon arrival at the international airports of the Republic of Kazakhstan (check with specialists for details).
Basis: an invitation letter from a Kazakh company (or a law firm, if the company has not yet been registered) with visa support approved by the Migration Service of the Ministry of Internal Affairs of the Republic of Kazakhstan.

How to get a C5 visa for business immigrants The process of obtaining is divided into two stages.

What is done after arrival in Kazakhstan

Having entered on a one-time C5 visa, a business immigrant must:
• Register or buy a share in an LLP;
• Deposit the authorized capital (minimum — according to the law in the Bank of the Republic of Kazakhstan).

5. Power of attorney for the representative. Review period: 7-10 business days, may be up to 30 days in coordination with the National Security Committee. • Validity period: multiple—entry visa for 2 years (up to 3 years - for ethnic Kazakhs).

When: after registering the company and depositing funds.
What you need: a letter of application from the Akimat for a multiple-entry visa (the preparation period is about 15 working days).
A business plan with investment data is required. Where to apply: the application is sent to the Migration Service, after which they apply for a visa extension.

Company registration

If you do not register a company or invest capital on time, the Ministry of Internal Affairs may shorten your stay.

Incomplete package

The Akimat may refuse if the package is incomplete or the business plan is weak.

References

It is difficult to obtain the necessary information (for example, about the absence of a ban on business) in some countries.

Additional difficulties

Invitation

There is no invitation without a company, and no visa without an invitation. Legitimate solutions are provided individually.

Date

Extension applications are often submitted too late (30 days before the end of the visa) — it is better to start in advance.

One-time visa

If you leave after obtaining a single-entry visa, it will be canceled, and you will have to go through the process again.
